Brgy Nazareth amendatory ordinance on cleanliness under study

THE City Council Committee on Barangay Affairs, chaired by Councilor Marlo L. Tabac, is set to deliberate on the proposed ordinance of Barangay Nazareth seeking to amend the penalty clause of SB Ordinance No. 3-2023, otherwise known as the ordinance requiring all residential owners or occupants, business establishments, and government offices to observe the “Tugkaran Ko, Limpyuhan Ko” program.
In its legal opinion dated June 27, 2025, the City Legal Office recommended the exclusion of penalty provisions from the proposed barangay ordinance, citing the existing implementation of the Ordinance Violation Receipt (OVR) system under City Ordinance No. 13671-2019.
The CLO emphasized that under Rule II, Section 2(c), and Rule IV, Section 5 of the said ordinance, barangay officials and deputized individuals are already authorized to issue OVRs for violations of city ordinances.
These include barangay tanods, barangay health workers, and members of accredited non-government organizations, provided they have completed the deputation seminar and received authorization from the City Mayor upon recommendation of the OVR Grievance Board.
Given that the proposed barangay ordinance aims to supplement and localize city laws within the barangay’s jurisdiction, the CLO noted that including separate penalty clauses may cause confusion in enforcement and may result in issues of double penalty or overlapping sanctions for the same violation.
