Proposed law governing private-public partnership in CdeO up for approval

THE 18th City Council headed by Vice Mayor Raineir Joaquin V. Uy is set to act on the proposed city code pursuing a public-private partnership (PPP) approach towards development.


This, after the committee on planning and development and on laws and rules, both chaired by Councilor Ian Mark Nacaya, endorsed the approval of the proposed legislation, which provides the procedure for selecting the private sector proponent. It also includes the adoption of a contract management framework.


In his letter to Vice Mayor Uy, Mayor Oscar Moreno said the draft of the Cagayan de Oro Public-Private Partnership for the People (P4) is adopted from Annex 1 of DILG Memorandum Circular No. 2016-120.


The circular provides guidelines for private sector participation in the provision of public infrastructure and social services.


The legislation is in line with the policy of the city to advance public welfare and prompt the interest of the community and the city within the framework of sustainable and integrated development. It also aims to provide an effective constructive engagement and meaningful participation of people in local governance.


The Power learned that the rationale of P4 is to provide better, affordable and timely services to the community, among others. The proposed law cites that P4 projects should be feasible, affordable and bankable and must also provide economic and social benefits.


The proposed ordinance mandates the creation of a P4 selection committee (P4-SC) for purposes of selecting a PSP for a specific P4 project. The committee, which will be constituted by the city mayor, shall be composed of a chairperson, secretary, the city treasurer, the city planning and development officer, one representative from and selected by the City Council and two representatives from and chosen by accredited people’s organizations, non-government organizations and CSOs who are members of the city, Municipal Development Council/Regional Economic and Development Board.
