Cabanlas backs request to declare Reyes Village as abandoned subdivision

“KUNG wala na gyud ang developer, the city will accept the donation from the homeowners”.
This was assured by Councilor Edgar S. Cabanlas, during the recent meeting of the City Council committee on subdivision and landed estate, as he explained to the members of Reyes Village Subdivision Homeowners Association (RVSHOA), regarding their request to declare the subdivision as abandoned.

It was learned that the Barangay Council of Bugo, headed by Punong Barangay Spencer Cailing, passed a resolution supporting the request of RVSHOA, citing that the subdivision, not declared as completed, was allegedly neglected by its developer.
During the recent meeting, Barangay Chair Cailing said the subdivision was abandoned for years after it was developed in 1982. He said consultation and field verifications were conducted by the barangay with the members of homeowners association.

Mr. Emilor Cabanos, president of the RVSHOA, said the subdivision has no concrete roads, and few building structures. Almost all of the improvements of the subdivision were initiated and developed by the city government and funded by congressional and city funds, he added.
According to Councilor Cabanlas, the law provides that a subdivision is considered abandoned if it remains incomplete after 10 years from the target completion date and the developer either has no intention to proceed with the project or cannot be located despite diligent efforts for the last 5 years.
He advised the homeowners to initiate its donation to the city. “That is the start of the legality of the management of the homeowners for the open spaces including roads of the subdivision”, said Cabanlas.
The committee will convene again and will invite the representatives of City Engineer’s Office, City Planning and Development Office, (CPDO), City Mayor’s Office, City Legal Office, Department of Human Settlement and Urban Development (DHSUD), and contractor of the proposed Dome project in the area.
